# Terms of Service - Western Home Jobs

**IMPORTANT**: Please read these Terms of Service carefully before using the Western Home Jobs app.

## 1. Acceptance of Terms

By accessing or using the Western Home Jobs mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

## 2. Description of Service

Western Home Jobs is a **marketplace platform** that connects homeowners with workers for household jobs and services in Coos County, Oregon.

### What We Provide:
- Platform to post and browse job listings
- Messaging system between homeowners and workers
- Payment processing for job posting fees
- Rating and review system

### What We DO NOT Provide:
- We do NOT perform any work or services
- We do NOT employ workers
- We do NOT guarantee work quality
- We do NOT verify worker qualifications or backgrounds
- We do NOT resolve disputes between users

## 3. Eligibility

### Age Requirements:
- You must be **18 years or older** to create an account and post jobs
- Users aged **13-17** may use the app with parental/guardian supervision for "Teen Jobs" only
- We do not knowingly collect information from children under 13

### Account Requirements:
- One account per person
- Provide accurate, current information
- Maintain the security of your password
- Not share your account with others

## 4. User Roles

### 4.1 Homeowners
**Can:**
- Post job listings (first 25 jobs free globally, then $3+ per job)
- Review applications from workers
- Accept applications and hire workers
- Message accepted workers
- Rate and review workers after job completion

**Must:**
- Provide accurate job descriptions
- Specify fair, legal pay rates
- Treat workers with respect
- Pay agreed-upon amounts
- Comply with all employment laws

### 4.2 Workers
**Can:**
- Browse available jobs
- Apply to jobs with messages
- Message homeowners after being accepted
- Complete jobs
- Rate and review homeowners

**Must:**
- Provide accurate application information
- Complete accepted jobs professionally
- Follow homeowner instructions
- Comply with all safety regulations

### 4.3 Switching Roles
- Users can switch between homeowner and worker roles
- History and ratings are maintained for each role

## 5. Job Posts and Fees

### 5.1 Posting Jobs
- First **25 jobs globally** across all users: **FREE** (promotional period)
- After 25 jobs:
- **Regular Job Post**: $3
- **Urgent Priority Job**: $6 (highlighted and prioritized)
- **Featured Job Post**: $10 (premium placement)
- **Urgent + Featured**: $13 (both benefits)
- Jobs must be legal and comply with these Terms
- Jobs pending admin approval before becoming visible

### 5.2 Payment
- All payments processed securely via RevenueCat (using Apple, Google, or web payment systems)
- Fees are **non-refundable** once a job is posted
- You are responsible for ensuring payment method is valid

### 5.3 Job Approval
- All jobs are reviewed by an admin before approval
- We reserve the right to reject any job that violates these Terms
- No refunds for rejected jobs

## 6. Subscriptions and In-App Purchases

### 6.1 Subscription Plans
If we offer subscription plans or premium features:
- Subscription details (pricing, features, duration) are displayed in the app
- Subscriptions may be offered on a monthly, annual, or other recurring basis
- Prices are subject to change with 30 days notice to active subscribers

### 6.2 Billing and Auto-Renewal
**For Apple App Store subscriptions:**
- Payment will be charged to your iTunes Account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your device Account Settings after purchase

**For Google Play subscriptions:**
- Payment will be charged to your Google Play Account at confirmation of purchase
- Subscription automatically renews unless canceled at least 24 hours before the end of the current period
- Manage subscriptions in Google Play Store settings

**For Web/RevenueCat subscriptions:**
- Payment will be charged to your payment method at confirmation of purchase
- Subscription automatically renews unless canceled before the renewal date
- Manage subscriptions through your account settings in the app

### 6.3 Free Trials
If we offer free trials:
- Free trial duration will be clearly stated before signup
- You will be charged at the end of the trial unless you cancel before the trial ends
- Cancel anytime during the trial to avoid charges

### 6.4 Cancellation Policy
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds for partial subscription periods
- Access to subscription features continues until the end of the paid period

### 6.5 Refund Policy for Subscriptions
**Apple App Store:**
- Refunds are handled by Apple according to their policies
- Request refunds through the App Store by visiting reportaproblem.apple.com
- We do not control or process App Store refunds

**Google Play Store:**
- Refunds are handled by Google according to their policies
- Request refunds through Google Play Store settings
- We do not control or process Google Play refunds

**Web Purchases:**
- Subscription fees are generally non-refundable
- Refund requests evaluated on a case-by-case basis
- Contact support@westernhomejobs.com for refund requests

### 6.6 Changes to Subscription Features
We reserve the right to:
- Modify subscription features and pricing
- Discontinue subscription plans with 30 days notice
- Existing subscribers maintain their current pricing until renewal

## 7. Prohibited Activities

You may NOT:

### 6.1 Illegal Activities
- Post jobs for illegal services
- Use the app for any unlawful purpose
- Violate any local, state, or federal laws

### 6.2 Fraudulent Activities
- Provide false information
- Impersonate another person
- Create multiple accounts
- Manipulate ratings or reviews

### 6.3 Harmful Content
- Post discriminatory or hateful content
- Harass, threaten, or intimidate other users
- Post explicit, violent, or inappropriate content
- Spam or advertise unrelated services

### 6.4 Platform Abuse
- Attempt to bypass payment systems
- Scrape or collect user data
- Interfere with app functionality
- Reverse engineer the app

### 6.5 Off-Platform Transactions
While not prohibited, we strongly discourage arranging jobs outside the app:
- No protection if disputes arise
- No ability to rate/review
- No record of the transaction

## 8. Marketplace Disclaimer

**IMPORTANT - READ CAREFULLY:**

### 7.1 Platform Only
Western Home Jobs is a **MARKETPLACE PLATFORM ONLY**. We:
- Are NOT a party to any agreements between homeowners and workers
- Do NOT employ, supervise, or control workers
- Do NOT guarantee work quality, completion, or timeliness
- Do NOT verify credentials, licenses, or background checks
- Are NOT responsible for worker actions or homeowner conduct

### 7.2 User Responsibility
**YOU ARE SOLELY RESPONSIBLE FOR:**
- Verifying worker qualifications and references
- Conducting background checks if desired
- Ensuring proper insurance coverage
- Complying with employment and tax laws
- Workplace safety and injury prevention
- Quality of work performed
- Payment disputes
- Property damage or personal injury

### 7.3 Independent Contractors
All workers are independent contractors, not employees of:
- Western Home Jobs
- The platform operators
- Other users

Workers are responsible for:
- Their own taxes
- Their own insurance
- Their own tools and equipment
- Their own liability and workers' compensation

## 9. Liability and Indemnification

### 8.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are NOT liable for any damages arising from your use of the app
- This includes property damage, personal injury, lost wages, or any other damages
- Our total liability shall not exceed the fees you paid in the past 12 months (maximum $100)

### 8.2 Indemnification
You agree to indemnify and hold harmless Western Home Jobs, its operators, and affiliates from:
- Any claims arising from your use of the app
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Disputes with other users

**Example**: If a worker you hired causes property damage, you cannot sue Western Home Jobs. You must resolve the issue with the worker directly.

## 10. User Content

### 9.1 Your Content
You retain ownership of content you post (job descriptions, messages, photos, reviews).

By posting content, you grant us a license to:
- Display it in the app
- Store it on our servers
- Use it for app improvement and analytics

### 9.2 Content Standards
All content must:
- Be accurate and not misleading
- Not violate any laws
- Not infringe on others' rights
- Not contain malware or harmful code

### 9.3 Content Removal
We reserve the right to remove any content that:
- Violates these Terms
- Is reported by users
- Is deemed inappropriate or harmful

## 11. Ratings and Reviews

### 10.1 Rating System
- Users can rate each other after job completion
- Ratings are 1-5 stars with optional comments
- Ratings are permanent and cannot be edited after 24 hours

### 10.2 Review Standards
Reviews must:
- Be based on actual interactions
- Be honest and accurate
- Not contain personal attacks
- Not violate these Terms

Fake or fraudulent reviews will result in account termination.

## 12. Account Termination

### 11.1 By You
You may delete your account at any time by contacting support@westernhomejobs.com.

When you delete your account:
- Your profile and personal info are permanently deleted
- Your job posts and applications are anonymized
- You lose access to all account data

### 11.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- You receive multiple negative reports
- Your account is inactive for 12+ months

### 11.3 Effect of Termination
Upon termination:
- You must stop using the app immediately
- All licenses granted to you are revoked
- We may delete your data (except as required by law)
- Outstanding fees remain due

## 13. Intellectual Property

### 12.1 Our Rights
The app, including all content, features, and functionality, is owned by Western Home Jobs and protected by copyright, trademark, and other intellectual property laws.

You may NOT:
- Copy, modify, or distribute the app
- Use our name, logo, or branding without permission
- Create derivative works

### 12.2 User Trademarks
If you use the app for business purposes, you may mention that you use our platform, but you may not imply endorsement or partnership.

## 14. Privacy

Your privacy is important to us. Please review our [Privacy Policy](link-to-privacy-policy) to understand how we collect, use, and protect your information.

Key points:
- We collect email, name, job posts, and usage data
- We use Firebase and RevenueCat as service providers
- We do NOT sell your personal information
- You can delete your account anytime

## 15. Dispute Resolution

### 14.1 User Disputes
Disputes between users (homeowner vs. worker) are NOT our responsibility. You must resolve them directly or through legal channels.

We recommend:
- Communicate clearly and professionally
- Review the job details and agreements
- Consider mediation or small claims court
- Document all communications

### 14.2 Disputes with Us
If you have a dispute with Western Home Jobs:
1. Contact us at support@westernhomejobs.com
2. We will attempt to resolve within 30 days
3. If unresolved, disputes will be resolved through binding arbitration

### 14.3 Arbitration
Any disputes that cannot be resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association.

**YOU WAIVE YOUR RIGHT TO:**
- Trial by jury
- Participate in class action lawsuits

**Exception**: You may pursue claims in small claims court if they qualify.

### 14.4 Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.

Venue for any disputes is Coos County, Oregon.

## 16. Changes to Terms

We may update these Terms at any time. Changes will be effective:
- Immediately upon posting for new users
- 30 days after posting for existing users

We will notify you of material changes via:
- In-app notification
- Email to your registered address

Continued use of the app after changes constitutes acceptance.

## 17. Warranties and Disclaimers

### 16.1 No Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do NOT warrant:
- Uninterrupted or error-free operation
- Accuracy of content
- Fitness for a particular purpose
- Security of data transmission

### 16.2 Use at Your Own Risk
You use the app at your own risk. We are not responsible for:
- Injuries or property damage
- Lost income or business opportunities
- Data loss or security breaches
- Third-party actions or content

## 18. Miscellaneous

### 17.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Western Home Jobs.

### 17.2 Severability
If any provision of these Terms is found invalid, the remaining provisions will remain in effect.

### 17.3 No Waiver
Our failure to enforce any right or provision does not waive that right.

### 17.4 Assignment
You may not assign these Terms. We may assign them to any successor or affiliate.

### 17.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our control (natural disasters, strikes, government actions, etc.).
